DUDE BIKES RENTAL TERMS

1. GENERAL

1.1. These terms and conditions regulate the rental of vehicles and additional equipment under the rental agreement and determine the rights and obligations of the parties.

1.2. The terms and conditions include the rental agreement, insurance terms and conditions, service price list and privacy policy.

1.3. The lessor is DUDE BIKES, Meža 4, Riga, LV40103914312

1.4. The Lessee is a person who meets the requirements and agrees to the terms and conditions. The Lessee does not have the right to transfer or sell the leased property.

2. DEFINITIONS

• Renter – a person who has a valid driver's license and who uses the rental service.
• Vehicle – a two-wheeled motor vehicle, that is being rented.
• Additional equipment – additional items available for rental (e.g. helmets, motorcycle clothing, etc.).
• Rental period – a 24-hour period starting at 10:00.
• Rental fee – cost according to the rental period and selected additional services.
• Services – rental service, insurance, maintenance and other services according to the price list.
• Rental base – a location where the vehicle and accessories are delivered and returned.

3. RESERVATION AND RENTAL CONDITIONS

3.1. The Renter may use the services only after completing the reservation and necessary procedures.

3.2. When making a reservation, you must agree to the terms and conditions and provide the required information (name, contacts, driver's license number, etc.).

3.3. If false information is entered, the lessor has the right to cancel the reservation.

3.4. Cancellation of a reservation:

• Free of charge up to 30 days before the start of the rental period.
• Less than 30 days before the start of the rental period, the full rental fee will be due unless cancellation protection is selected.

3.5. To make a reservation, you must select a suitable vehicle on the dude-bikes.com website.

3.6. Payment of the rental fee is made before the start of the rental period.

3.7. The renter must pay a deposit, which will be returned if the vehicle and additional equipment are in good condition.

4. VEHICLE OPERATION RULES

4.1. The renter must inspect the vehicle before use and immediately report any possible damage or defects. The renter must also record the vehicle's mileage before the start of the rental and provide mileage information after returning the vehicle (for example, send a photo via SMS). 

4.2. The vehicle may not be used for racing, off-roading, transporting heavy goods, driving lessons or in any other non-intended manner.

4.3. The renter is responsible for the vehicle and additional equipment and must ensure its security (locking, alarm system, etc.).

4.4. The vehicle may only be used in the European Union (except Russia, Belarus, Ukraine, etc.). Departure from the territory of Latvia or Lithuania must be coordinated.

4.5. The renter must be sober and in good health and must not give the vehicle to third parties.

4.6. The vehicle has a mileage limit according to the selected mileage package. If the mileage is exceeded, a surcharge of 0.5 €/km will apply.

5. ACCIDENTS AND DAMAGES

5.1. The renter must immediately report any accidents, theft, damage or technical problems.

5.2. The vehicle is insured with motor third party liability insurance. The renter is liable up to the deductible or if the damage is not covered by insurance.

5.3. The renter is obliged to compensate for all damages resulting from a violation of the terms of the contract (e.g. leaving the permitted driving area, learning to drive, driving under the influence of alcohol or drugs).

5.4. The lessor has the right to charge a fee for cleaning the vehicle if it requires more thorough cleaning than usual.

5.5. If the vehicle is returned with less fuel than when it was delivered, the missing fuel must be paid for according to the price list.

6. RETURN

6.1. The vehicle must be returned at the agreed time and place. In case of delay, an additional fee will be applied for each 24 hours started.

6.2. The Lessee is responsible for the condition of the vehicle until its direct possession is transferred to the Lessor.

6.3. The lessor may also file claims after return if the damage is discovered within 7 days at the latest.

6.4. The rental fee will not be refunded in case of premature return.

7. PAYMENT TERMS

7.1. Unforeseen costs may be added to the rental fee (e.g. parking fines, fuel costs, cleaning fees, late fees, repair costs).

7.2. If payment deadlines are exceeded, a late payment interest of 0.5% per day will be added.

7.3. The lessor has the right to suspend services and block the vehicle if the lessee fails to fulfill payment obligations or the terms of the contract.

8. OTHER CONDITIONS

8.1. The lessor has the right to unilaterally change the terms and conditions and service fees.

8.2. Disputes will be resolved through negotiations; if necessary, disputes will be resolved by a court of the Republic of Latvia.

8.3. The renter has the right to file a complaint with the Consumer Protection and Technical Surveillance Authority

DUDE BIKES MOTO NOMAS NOTEIKUMI

1. VISPĀRĪGIE NOTEIKUMI

1.1. Šie noteikumi regulē transportlīdzekļu un papildu aprīkojuma nomu saskaņā ar nomas līgumu un nosaka pušu tiesības un pienākumus.
1.2. Noteikumos ietilpst nomas līgums, apdrošināšanas noteikumi, pakalpojumu cenrādis un privātuma politika.
1.3. Iznomātājs: DUDE BIKES, Meža iela 4, Rīga, LV40103914312.
1.4. Nomnieks ir persona, kas atbilst prasībām un piekrīt noteikumiem. Nomniekam nav tiesību nodot vai pārdot iznomāto īpašumu trešajām personām.

2. DEFINĪCIJAS

• Nomnieks – persona ar derīgu vadītāja apliecību, kas izmanto nomas pakalpojumu.
• Transportlīdzeklis – divriteņu motorizēts transportlīdzeklis, kas tiek iznomāts.
• Papildu aprīkojums – papildu priekšmeti nomai (piemēram, ķiveres, motocikla apģērbs u.c.).
• Nomas periods – 24 stundu periods, sākot no plkst. 10:00.
• Nomas maksa – maksa atbilstoši nomas periodam un izvēlētajiem papildu pakalpojumiem.
• Pakalpojumi – noma, apdrošināšana, apkope un citi pakalpojumi saskaņā ar cenrādi.
• Nomas bāze – vieta, kur transportlīdzeklis un aprīkojums tiek izsniegts un atgriezts.

3. REZERVĀCIJA UN NOMAS NOSACĪJUMI

3.1. Nomnieks var izmantot pakalpojumu tikai pēc rezervācijas veikšanas un nepieciešamo procedūru izpildes.
3.2. Veicot rezervāciju, jāpiekrīt noteikumiem un jāsniedz nepieciešamā informācija (vārds, kontakti, vadītāja apliecības numurs u.c.).
3.3. Ja sniegta nepatiesa informācija, iznomātājam ir tiesības rezervāciju atcelt.
3.4. Rezervācijas atcelšana:

• bez maksas līdz 30 dienām pirms nomas sākuma;
• mazāk nekā 30 dienas pirms nomas sākuma – jāmaksā pilna nomas maksa, ja nav izvēlēta atcelšanas aizsardzība.
  3.5. Rezervācija jāveic, izvēloties transportlīdzekli vietnē dude-bikes.com.
  3.6. Nomas maksa jāsamaksā pirms nomas perioda sākuma.
  3.7. Nomniekam jāiemaksā drošības depozīts, kas tiek atgriezts, ja transportlīdzeklis un aprīkojums ir labā stāvoklī.

4. TRANSPORTLĪDZEKĻA LIETOŠANAS NOTEIKUMI

4.1. Nomniekam pirms lietošanas jāpārbauda transportlīdzeklis un nekavējoties jāziņo par bojājumiem vai defektiem. Jāfiksē nobraukums pirms nomas un pēc atgriešanas (piemēram, nosūtot foto SMS veidā).
4.2. Transportlīdzekli aizliegts izmantot sacensībām, bezceļiem, smagu kravu pārvadāšanai, braukšanas apmācībām vai citādi neatbilstoši paredzētajam mērķim.
4.3. Nomnieks ir atbildīgs par transportlīdzekli un aprīkojumu un nodrošina tā drošību (slēdzenes, signalizācija u.c.).
4.4. Transportlīdzekli drīkst izmantot tikai Eiropas Savienībā (izņemot Krieviju, Baltkrieviju, Ukrainu u.c.). Izbraukšana ārpus Latvijas vai Lietuvas jāsaskaņo.
4.5. Nomniekam jābūt skaidrā un labā veselības stāvoklī, un transportlīdzekli nedrīkst nodot trešajām personām.
4.6. Transportlīdzeklim ir nobraukuma limits atbilstoši izvēlētajam paketēm; par pārsniegumu piemēro piemaksu 0,5 €/km.

5. NEGADĪJUMI UN BOJĀJUMI

5.1. Par negadījumiem, zādzību, bojājumiem vai tehniskām problēmām nekavējoties jāziņo.
5.2. Transportlīdzeklis ir apdrošināts ar OCTA. Nomnieks atbild līdz pašriskam vai gadījumos, kad bojājumus nesedz apdrošināšana.
5.3. Nomniekam jāatlīdzina visi zaudējumi, kas radušies līguma noteikumu pārkāpuma dēļ (piemēram, izbraukšana ārpus atļautās teritorijas, braukšanas apmācība, braukšana alkohola vai narkotiku ietekmē).
5.4. Iznomātājs var piemērot papildu maksu par pastiprinātu transportlīdzekļa tīrīšanu.
5.5. Ja transportlīdzeklis tiek atgriezts ar mazāku degvielas daudzumu nekā izsniegšanas brīdī, starpība jāapmaksā saskaņā ar cenrādi.

6. ATGRIEŠANA

6.1. Transportlīdzeklis jāatgriež noteiktajā laikā un vietā. Kavējuma gadījumā tiek piemērota maksa par katrām uzsāktām 24 stundām.
6.2. Nomnieks ir atbildīgs par transportlīdzekļa stāvokli līdz tā nodošanai iznomātājam.
6.3. Iznomātājs var iesniegt pretenzijas arī pēc atgriešanas, ja bojājumi konstatēti ne vēlāk kā 7 dienu laikā.
6.4. Priekšlaicīgas atgriešanas gadījumā nomas maksa netiek atmaksāta.

7. MAKSĀJUMU NOTEIKUMI

7.1. Nomas maksai var tikt pievienoti neparedzēti izdevumi (piemēram, stāvvietas sodi, degvielas izmaksas, tīrīšanas maksa, kavējuma maksa, remonta izmaksas).
7.2. Par maksājumu kavējumu tiek piemēroti nokavējuma procenti 0,5% dienā.
7.3. Iznomātājam ir tiesības apturēt pakalpojumu sniegšanu un bloķēt transportlīdzekli, ja nomnieks nepilda maksājumu vai līguma saistības.

8. CITI NOTEIKUMI

8.1. Iznomātājam ir tiesības vienpusēji mainīt noteikumus un pakalpojumu cenas.
8.2. Strīdi tiek risināti sarunu ceļā; nepieciešamības gadījumā – Latvijas Republikas tiesā.
8.3. Nomniekam ir tiesības iesniegt sūdzību Patērētāju tiesību aizsardzības un tehniskās uzraudzības iestādē.
